Payday loans are a form of short-term lending generally used to ease the financial position of an individual between the time of the loan and payday hence the name Payday Loans.

Part of the spirit of the changes that came into play but meant to prevent people from getting to payday loan spirals and also highlighting the fact that lenders needed to ensure that they were treating customers fairly.

  • My loan has been written off by my payday lender, am I entitled to any refund?

    Yes, in some cases you will be entitled to a refund where your payday lender has sought fit to cancel your loan.

  • As a result of my payday loan, I am now in financial difficulties. Do I have a claim?

    Yes, you may have a claim as the payday lender does have a duty to assess your financial circumstances insofar as it relates to your ability to afford repayments on the loan.

  • I know nothing about the high interest rates. Am I able to ask for a refund?

    In circumstances where you are not made aware of the high interest rates, it may well be arguable that you have not been treated fairly by the lender, or given the information that you needed to establish whether the loan was the correct thing for you and, as such, you may be entitled to some of that interest back.

  • I have been charged high default fees of £30.00 by my payday lender. Can I get these back?

    Yes, we believe that sometimes default fees can be excessive and, in those circumstances, you should be able to succeed in a complaint to the lender requesting that the default fees be paid back.

  • As a result of taking out my payday loan I am now in greater financial difficulty than I was when I started. Do I have a claim?

    If the lender should have been made aware of your financial circumstances and proceeded to continue to lend money to you then it is arguable that they have failed to treat you fairly and should consider putting you in the position that you would have been in had they treated you fairly and that would sometimes include repaying the monies that they charged you back.
